These Terms of Service (“Terms”) govern your access to and use of the DataDawg service - a digital top-up and bill-payment service that lets you buy airtime, mobile data, pay bills, and manage a prepaid wallet, primarily through WhatsApp and our website at https://datadawg.xyz (the “Service”).
The Service is operated by DataDawg Services, a business registered in Nigeria under the Companies and Allied Matters Act 2020 (Business Name Registration No. 9462036), with its principal place of business at Plot 11 Zone B, Liadi, Maya, Ikorodu, Lagos State, Nigeria (“DataDawg”, “we”, “us”, or “our”).
Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
2. Your Account
- Your account is identified by your phone number and secured by a transaction PIN and email one-time-password (OTP) verification.
- You are responsible for keeping your PIN and access to your phone number and email confidential. Any activity carried out through your account is deemed to be authorised by you.
- Notify us immediately through the DataDawg assistant if you suspect unauthorised use of your account. We may suspend an account to protect it while we investigate.
- One person may hold one account. You may not create an account on behalf of anyone else without authority to do so.
3. Wallet and Funding
- Your DataDawg wallet holds a prepaid balance you can use to pay for airtime, data, and bills. The wallet is not a bank account, does not earn interest, and is not a deposit or savings product.
- You fund your wallet through our payment partners (such as Paystack and Monnify), including via a dedicated virtual account where one is issued to you. Funds are credited once we receive confirmation from the payment partner.
- We are not responsible for delays, failures, or charges arising from your bank or payment provider. You are responsible for funding your wallet from sources you are lawfully entitled to use.
- We may place limits on wallet balances or transaction amounts for security, regulatory, or fraud-prevention reasons.
4. Purchases - Airtime, Data, and Bills
- When you place an order, you authorise us to debit your wallet for the amount shown and to deliver the airtime, data bundle, electricity token, TV subscription, or other product to the recipient details you provide.
- You are responsible for the accuracy of recipient details - including phone numbers, networks, meter numbers, and smartcard numbers. We cannot reverse a purchase that was correctly delivered to the details you entered.
- Products are supplied by third parties such as mobile networks, electricity discos, and TV providers. Their availability, pricing, and delivery times are outside our control.
5. Fees and Pricing
The price of each product is displayed before you confirm a purchase. Prices may change at any time to reflect the rates set by our providers. Any service fees will be shown to you before you complete a transaction. You agree to pay all amounts due for transactions you authorise.
6. Refunds and Reversals
- Where a transaction fails after your wallet has been debited, the amount is automatically returned to your wallet balance.
- Successfully delivered products (for example, airtime or a data bundle sent to the number you entered) are not refundable. Purchases sent to an incorrect recipient because of details you provided cannot be reversed.
- Wallet balances funded from a payment source may, at our discretion and subject to verification, be withdrawn or refunded to the original source in line with our support process and applicable law.
7. Acceptable Use
You agree not to use the Service to:
- break any law, or facilitate fraud, money laundering, or terrorism financing;
- use payment instruments, funds, or accounts you are not authorised to use, or make unauthorised or fraudulent transactions;
- resell, abuse, or exploit the Service, or attempt to bypass pricing, limits, or security controls;
- access the Service by automated means, probe or scan its systems, or interfere with its operation or security;
- impersonate another person or provide false information.
We may investigate suspected misuse and cooperate with law enforcement. We may refuse, cancel, hold, or reverse transactions we reasonably believe are fraudulent, unlawful, or in breach of these Terms.
8. Service Availability
We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted, error-free, or always available. The Service, its features, and its providers may change, be suspended, or be withdrawn at any time. Maintenance, provider outages, and events beyond our control may affect delivery.
9. Intellectual Property
The DataDawg name, logo, branding, software, and content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that products supplied by third-party providers will be free of defects or delivered without delay, and we make no warranty regarding merchantability or fitness for a particular purpose.
11. Limitation of Liability
To the fullest extent permitted by law, DataDawg and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising from or relating to your use of the Service.
Where liability cannot lawfully be excluded, our total aggregate liability to you for any claim relating to the Service is limited to the amount of the specific transaction giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless DataDawg and its owners, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.
13. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access - with or without notice - if you breach these Terms, if we are required to by law, or if we reasonably suspect fraud or misuse. On termination, any remaining wallet balance may be returned to you subject to verification and any lawful deductions. Provisions that by their nature should survive termination - including intellectual property, disclaimers, liability, and indemnity - will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where changes are significant, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms. The current version is always available at this page.
15. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Nigeria. We encourage you to contact us first so we can try to resolve any issue directly.
